Love conquers all!

« on: December 01, 2011, 08:04:51 AM »

So my love was giving an 85% sentence because his charge is under the classification of a violent crime. His indictment list his charge but say non force. Under the law violent crime is defined as a crime in which force was used by either threat or weapon. Or thats how I took it. So since there was no force how can it be deemed violent. Why does someone who halfa brain not realize that there are cases that do not fit their so called guidelines? Not every crime is the case study they designed the rule for!

I have read your previous postings.  Your loved one was convicted for 10 years of sexual assault of a minor, am I correct?  This is considered a violent offense, as the inference is that he, of legal age forced himself on the person who was not at a legal age to consent.

There has been at least other IPT person who have successfully had their convictions turned over because of inconsistencies with proper representation and testimony;   hopefully your loved one is going to do an appeal and he can be the next successful overturned conviction.

It sounds so horrible to hear someone else say it, but ya your correct. And I know a lot of people say this but he didnt do this :( Is there anyway you could get me in contact with some of those members.  Iam trying everything. Reasearching day in and day out. Just to find anything togive hope on an early release. We did file an appeal and the he does have sentence reduction hearing end of this month.

my fiance is also listed as a violent offender because of the age of the victim.  i'm new and learning all of this too but i'd be happy to help in any way i can.  i know my fiance was able to get his sentence reduced because of some truth in sentencing law and he got it reduced by 3 years.  feel free to message me if you want to talk

I am very familiar with the appeals process for this type of conviction.  Feel free to PM me if you need some help with it.
