Just a question about taxes. My husband worked 2 months of last yr before he went in. Can i file a married return and and his income. Will they take our taxes if i file a joint return?

 I filed married filing jointly last head using a w2 from 2010. But I was told.you either have to file online or have a power of attorney. But that is my experience.

I'd call a tax professional and ask.  Or call the IRS.  They're super nice at the IRS if you call them, before you make an error and they have to call you  wc1

File on line then there are no questions asked if you do it on paper need to send a copy of power aof attorney ..

Does anybody know if it is true that the State of Illinois will take any refund that an inmate will receive? Does this apply to federal taxes as well?

Hopefully RT will stop by and give us some pointers. He is an expert on filing taxes when an inmate is involved.

But, if I remember correctly, they will not take a refund that is filed under married status.

Thanks Marks_guy but most likely he will be filing head of household just like the past 2 years. He started his incarceration at the end of July.

Does anyone know if the $15 /month that they get while incarcerated count as income for taxes.  We have not received any 1099 or w2 form in the mail.  I'm sure uncle Sam wants his cut but because its so small.  Not sure if all tax people will know how to handle this situation.  And I'm afraid to ask but need to file our taxes soon.  And I'm not sure of the exact amount he got because it changed a few times.  I do have POA.

You only get 1099 if your income was at least $600.

No, their state pay does not count as income to be claimed.
