I found this will the laws enacted beginning Jan 1, 2012

Andrea’s Law (HB 263/PA 97-0154): Creates a First Degree Murderer Database for people convicted of first degree murder who have been released from a penal institution or other facility. Places them on the existing Sex Offender Registry or the amended Murderer and Violent Offender Against Youth Registry.

My question is what determines which list they fall under? I know someone that has a murder charge and on IDOC for the past several years it has sex offender registry because the victim was 17. It's confusing to put someone on a sex registry and they are not a sex offender. If there is to be a database for convicted murderers then why aren't they in that database?

We have talked about this on IPT since the bill was first brought forward, here are some links for you to check out:

http://www.illinoisprisontalk.org/index.php/topic,22241.msg172661.html#msg172661

http://www.illinoisprisontalk.org/index.php/topic,26088.msg205896.html#msg205896

There is also a current topic talking about this too here:

http://www.illinoisprisontalk.org/index.php/topic,25907.msg205007.html#msg205007

Also, you can go right to the registry and look up the FAQ's here:

http://www.isp.state.il.us/cmvo/cmvo.cfm

If they committed first degree murder and were originally on the SO registry, it is my understanding that they would now have to register under the new database once they are released.
