Hello:  Our loved one had court yesterday and he was resentenced to Conditional Discharge and is to be released from IDOC.  Does anyone know the procedure for this and how long it will take for him to actually be released?  I've heard a few different things.  Thanks!

How did they change his sentence if he was already in IDOC?

It was a mess to begin with...he was originally sentenced to bootcamp and when he checked in at Stateville, immigration put a hold on him because he is a legal resident, not a citizen so he was denied bootcamp.  He appealed and when the judge found out he had been in the IDOC system all this time he changed the sentence to Conditional Discharge and dated the ruling as of Jan 7, 2011.  So technically, the first sentence is gone and the new sentence stands with no jail time and he must abide by probation type conditions for 3 years.  I'm not sure how this will effect the immigration hold though.  That's the latest worry.  He was a juvenile when he was arrested.

Normally, once the paperwork is updated they would release him, but if he has an immigration hold on him, they will probably pick him up.   Have you called and talked to his counselor or Field Services to see if they can give you any further information?

Yes I just spoke with his counselor at Pontiac and she gave me the ICE number to call with questions.  She told me that they will still contact ICE about his release from IDOC and they will determine what happens next.  Basically saying it's out of IDOC's hands.  I called the ICE number and got a voicemail.

Other members have gone through this, with a LO that had an immigration hold, so hopefully they will read this and give you some information.  I will try to do a search and if I find anything on IPT, will post the links.

I've been looking for information on what happens when ICE picks up an inmate for the last 18 months at least. So far I did not find any helpful information at all.... So if anyone knows the process, please share!
